For more information on this award, please refer to <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/awards\/awards-summary\/ma000081-summary\" target=\"_blank\" rel=\"noopener\">the Live Performance Award<\/a><\/span>.<\/p>\n<h2 id=\"title-idx-0\" class=\"icon-anchor\">What is the Live Performance Award?<\/h2>\n<p>The Live Performance Award is a set of regulations and guidelines that govern the employment conditions and entitlements of employees in the live performance industry in Australia.<\/p>\n<p>It includes definitions of various terms used in the award, such as &#8220;employee,&#8221; &#8220;employer,&#8221; &#8220;performer,&#8221; &#8220;musician,&#8221; and more. The award covers aspects such as minimum rates of pay, working hours, engagement types, allowances, and specific provisions for different roles within the industry, such as dancers, musicians, and crew members. It also addresses matters related to recordings, performances, accommodation, and other relevant aspects of the live performance sector.<\/p>\n<h2 id=\"title-idx-1\" class=\"icon-anchor\">Who is covered by the Live Performance Award?<\/h2>\n<h3>Coverage<\/h3>\n<p>The live performance industry means employers and employees who work in (or connected to) the:<\/p>\n<ul>\n<li aria-level=\"1\">producing (pre and post production), staging, lighting, audio and audio\/visual, presenting, performing, administrating, programming, workshopping, set and prop manufacturing, or<\/li>\n<li aria-level=\"1\">undertaking live theatre, performance art, operatic, orchestral, dance, erotic, variety, revue, comedy, multi-media, choral, or musical performances, productions, presentations, rehearsals, or concerts.<\/li>\n<\/ul>\n<p><strong>Examples of employees covered by the Live Performance Award include:<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">crowd controllers<\/li>\n<li aria-level=\"1\">car parking attendants<\/li>\n<li aria-level=\"1\">crewing employees<\/li>\n<li aria-level=\"1\">mail room attendants<\/li>\n<li aria-level=\"1\">program sellers<\/li>\n<li aria-level=\"1\">stage door attendants<\/li>\n<li aria-level=\"1\">stage hands<\/li>\n<li aria-level=\"1\">theatre attendants\/ushers<\/li>\n<li aria-level=\"1\">ticket sellers<\/li>\n<li aria-level=\"1\">turnstile attendants<\/li>\n<li aria-level=\"1\">tour guides<\/li>\n<li aria-level=\"1\">receptionists<\/li>\n<li aria-level=\"1\">administration and information services<\/li>\n<li aria-level=\"1\">account, booking and dispatch clerks<\/li>\n<li aria-level=\"1\">team leaders &#8211; call centres<\/li>\n<li aria-level=\"1\">customer service representatives<\/li>\n<li aria-level=\"1\">marketing or publicity assistants<\/li>\n<li aria-level=\"1\">qualified or unqualified sound and lighting technicians<\/li>\n<li aria-level=\"1\">prop and wig makers<\/li>\n<li aria-level=\"1\">machinists and tailors<\/li>\n<li aria-level=\"1\">technicians<\/li>\n<li aria-level=\"1\">performers involved in acting, singing, dancing, skating, aquatic performing, understudying and any other type of performing<\/li>\n<li aria-level=\"1\">musicians<\/li>\n<li aria-level=\"1\">conductors<\/li>\n<li aria-level=\"1\">vocalists<\/li>\n<li aria-level=\"1\">disc jockeys<\/li>\n<li aria-level=\"1\">karaoke hosts<\/li>\n<li aria-level=\"1\">opera principals<\/li>\n<li aria-level=\"1\">stage managers.<\/li>\n<\/ul>\n<p>The Live Performance Award includes labour\u00a0 hire businesses and their employees in the live performance industry.<\/p>\n<p><strong>The following employees and employers are not covered by the Live Performance Award:<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">models who are photographed and\/or models for hairdressers for advertising purposes<\/li>\n<li aria-level=\"1\">employers and their employees who work in movie theatres.<\/li>\n<\/ul>\n<h2 id=\"title-idx-2\" class=\"icon-anchor\">How are the hours of work arranged in the Live Performance Award ?<\/h2>\n<h3>Ordinary hours of work<\/h3>\n<ul>\n<li aria-level=\"1\">Weekly hours: 38 hours per week, except for the week before opening night or the first public performance, which can be up to 48 hours.<\/li>\n<li aria-level=\"1\">Daily hours: Up to 8 hours per day.<\/li>\n<li aria-level=\"1\">Workdays: No more than 6 days per week, between 9:00 am and 11:15 pm.<\/li>\n<li aria-level=\"1\">Minimum credited time: 2.5 hours for full-length performances or dress rehearsals, 1 hour for performances up to one hour.<\/li>\n<li aria-level=\"1\">Rehearsals or extra sessions: Minimum credited time of 2 hours.<\/li>\n<li aria-level=\"1\">Employer&#8217;s right to lay off employees: Up to 3 weeks within 26 weeks, only for production transfers or by mutual agreement.<\/li>\n<li aria-level=\"1\">Payments in broken weeks or transfers: Rehearsal days at 16.7% salary, performances at 12.5% salary; ordinary performance salary for mixed performing\/non-performing days in transfers Performance Award, leave entitlements for employees are determined by the National Employment Standards (<span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.fwc.gov.au\/documents\/awards\/resources\/nes.pdf\" target=\"_blank\" rel=\"noopener\">NES<\/a><\/span>) and the classification of the employee.<\/p>\n<h3>Annual leave<\/h3>\n<p>Annual leave is provided for in the <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.fwc.gov.au\/documents\/awards\/resources\/nes.pdf\" target=\"_blank\" rel=\"noopener\">NES<\/a><\/span>.<\/p>\n<ul>\n<li aria-level=\"1\">Before annual leave, the employer must pay the employee their regular weekly wage plus a 17.5% loading.<\/li>\n<li aria-level=\"1\">If an employee takes annual leave in advance, they are not entitled to the loading.
