For more information on this award, please refer to the <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/awards\/awards-summary\/ma000003-summary\" target=\"_blank\" rel=\"noopener\">Fast Food Industry Award [MA000003]<\/a><\/span>.<\/p>\n<h2 id=\"title-idx-0\" class=\"icon-anchor\">What is the Fast Food Industry Award?<\/h2>\n<p>The Fast Food Industry Award is a set of legal minimum employment standards and conditions that apply to employees working in the fast food industry in Australia.<\/p>\n<p>This award specifically focuses on the fast food sector and outlines the minimum wage rates, working hours, overtime, annual leave, sick leave, and other entitlements for employees working in various roles within the industry. These roles may include kitchen staff, customer service representatives, delivery drivers, and restaurant managers.<\/p>\n<p>The Fast Food Industry Award is designed to ensure fair treatment, rights, and reasonable conditions for fast food industry employees, promoting fairness and resolving disputes while maintaining industry integrity.<\/p>\n<h2 id=\"title-idx-1\" class=\"icon-anchor\">Who is entitled to the Fast Food Industry Award?<\/h2>\n<h3>Coverage<\/h3>\n<p>The Fast Food Industry Award covers employers and employees in the fast food industry who are involved in <strong>taking orders for, preparing, selling, and delivering fast food that is intended to be consumed away from the point of sale.<\/strong><\/p>\n<p>Employees who are covered by the award include :<\/p>\n<ul>\n<li>Taking orders (including via an app), cooking and selling fast food<\/li>\n<li>Baristas (in fast food shops or take-away cafes)<\/li>\n<li>Delivery drivers<\/li>\n<li>Supervisors of these employees<\/li>\n<li>Employees in charge of a fast food \/ take-away shop or outlet<\/li>\n<li>Cafes where the main food or drink is sold (and packaged) for take-away.<\/li>\n<\/ul>\n<p>The Fast Food Award also covers labour hire businesses and their employees who are placed with an organisation in the fast food industry.<\/p>\n<h3>Types of employment<\/h3>\n<p>An employee covered by this award must be one of the following:<\/p>\n<ul>\n<li><strong>A full-time employee<\/strong> who is engaged to work an average of 38 ordinary hours per week over a period of no more than 4 weeks.<\/li>\n<li><strong>A part-time employee<\/strong> who is engaged to work less than 38 ordinary hours per week and has predictable hours.<\/li>\n<li><strong>A casual employee<\/strong> who is engaged to work may be no more than 38 ordinary hours per week; or if they work according to a roster, their ordinary hours may be averaged over the roster cycle to be no more than 38 hours per week.<\/li>\n<\/ul>\n<h3>The Award does not generally cover<\/h3>\n<table>\n<tbody>\n<tr>\n<td><strong>The Fast Food Award does not cover\u00a0<\/strong><\/td>\n<td>cafes, restaurants, coffee shops or bars where the business mainly sells food and beverages to be eaten on the premises and\/or offers sit down and table service.<\/td>\n<\/tr>\n<tr>\n<td><strong>The Fast Food Award doesn\u2019t cover employers and employees who are already covered<\/strong><\/td>\n<td>\n<ul>\n<li>Restaurant Award<\/li>\n<li>Hospitality Award<\/li>\n<li>Retail Award<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td><strong>The Fast Food Award also doesn&#8217;t cover<\/strong><\/td>\n<td>employees who are delivering goods prepared by a fast food business and aren&#8217;t directly employed by them.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2 id=\"title-idx-2\" class=\"icon-anchor\">How is the shiftwork arranged in the Fast Food Industry Award?<\/h2>\n<h3>Hours of Work<\/h3>\n<table>\n<tbody>\n<tr>\n<td style=\"text-align: center;\"><strong>Employment type<\/strong><\/td>\n<td style=\"text-align: center;\"><strong>Ordinary hours per week<\/strong><\/td>\n<td style=\"text-align: center;\"><strong>Maximum daily<\/strong> hours<\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\">Full-time<\/td>\n<td style=\"text-align: center;\">38 hours per week over a period of no more than 4 weeks<\/td>\n<td style=\"text-align: center;\">11 hours<\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\">Part-time<\/td>\n<td style=\"text-align: center;\">less than 38 hours<\/td>\n<td style=\"text-align: center;\">11 hours<\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\">Casual<\/td>\n<td style=\"text-align: center;\">38 hours\u00a0 max ordinary hours \/ week<\/td>\n<td style=\"text-align: center;\">11 hours<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3>Shiftwork<\/h3>\n<p>While it was considered that many fast food establishments operate on a \u201824\/7\u2019 model and can facilitate shiftwork, the Commission ultimately held that the Fast Food Award does not currently contain any substantive shiftwork provisions.
