For more information on this award, please refer to <a href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/awards\/awards-summary\/ma000038-summary\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #3366ff;\">the road transport and distribution award[MA000038]<\/span><\/a>.<\/p>\n<h2 id=\"title-idx-0\" class=\"icon-anchor\">What is the Road Transport and Distribution Award?<\/h2>\n<p>The Road Transport and Distribution Award, is a set of legal minimum employment standards and conditions that apply to employees working in the road transport and distribution industry in Australia.<\/p>\n<p>The award sets out the minimum wage rates, working hours, overtime, annual leave, sick leave, and other entitlements for employees working in various roles within the road transport and distribution industry, such as driver&#8217;s assistants, truck, forklift, concrete mixer and crane drivers. The award is designed to ensure that employees in the road transport and distribution industry are treated fairly and receive reasonable pay and conditions for their work.<\/p>\n<h2 id=\"title-idx-1\" class=\"icon-anchor\">Who is entitled to the Road Transport and Distribution Award?<\/h2>\n<h3>Coverage<\/h3>\n<p>The road transport and distribution industry includes:<\/p>\n<ul>\n<li>transporting by road livestock, goods, wares, merchandise, materials or other things in any form (defined below)<\/li>\n<li aria-level=\"1\">receiving, handling or storing goods, wares, merchandise, materials or other things in any form at a distribution facility<\/li>\n<li aria-level=\"1\">storing and distributing livestock, goods, wares, merchandise, materials or other things in any form, in connection with air freight forwarding and customs clearance<\/li>\n<li aria-level=\"1\">mobile food vending<\/li>\n<li aria-level=\"1\">distributing and relocating new or used vehicles requiring the driving of the vehicle itself (applies from the first full pay period starting on or after 1 July 2018).<\/li>\n<\/ul>\n<p>\u2018In any form\u2019 means in a raw or natural state, wholly or partly manufactured, or as a solid, liquid or gas.<\/p>\n<p>\u2018Goods, wares, merchandise and any other things\u2019 includes:<\/p>\n<ul>\n<li>crude oil<\/li>\n<li aria-level=\"1\">gas condensate<\/li>\n<li aria-level=\"1\">petrol and petroleum products<\/li>\n<li aria-level=\"1\">dairy products<\/li>\n<li aria-level=\"1\">wholesale meat<\/li>\n<li aria-level=\"1\">quarried materials.<\/li>\n<\/ul>\n<p>Employers and employees in the following industries or activities are not covered by the Road Transport Award:<\/p>\n<ul>\n<li>chauffeuring<\/li>\n<li aria-level=\"1\">long distance driving (eg. interstate driving), if this is the principal or usual activity.<\/li>\n<\/ul>\n<p>The Road Transport Award doesn\u2019t cover employers and employees when they are covered by one of the following awards:<\/p>\n<ul>\n<li>Mining Award<\/li>\n<li aria-level=\"1\">Road Transport (Long Distance) Award (while doing long distance work)<\/li>\n<li aria-level=\"1\">Transport (Cash) Award<\/li>\n<li aria-level=\"1\">Waste Award.<\/li>\n<\/ul>\n<h3>Types of employment<\/h3>\n<p>An employee covered by this award must be one of the following:<\/p>\n<ul>\n<li>A full-time employee who is engaged to work an average of 38 ordinary hours per week over a period of no more than 4 weeks.<\/li>\n<li>A part-time employee who is engaged to work less than 38 ordinary hours per week and has predictable hours. A part-time employee must receive a minimum payment of 4 hours for each day they are engaged.<\/li>\n<li>A casual employee who is engaged to work may be no more than 38 ordinary hours per week; or if they work according to a roster, their ordinary hours may be averaged over the roster cycle to be no more than 38 hours per week. For each ordinary hour worked, a casual employee must be paid the ordinary hourly rate; and a loading of 25% of the ordinary hourly rate,<\/li>\n<\/ul>\n<h2 id=\"title-idx-2\" class=\"icon-anchor\">How are the working hours arranged in the Road Transport and Distribution Award ?<\/h2>\n<h3>Ordinary hours of work and roster cycles<\/h3>\n<table>\n<tbody>\n<tr>\n<td>\n<p style=\"text-align: center;\"><strong>Employees other than oil distribution workers<\/strong><\/p>\n<\/td>\n<td style=\"text-align: center;\"><strong>Oil distribution workers<\/strong><\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\">between 5.30 am and 6.30 pm.<\/td>\n<td>\n<p style=\"text-align: center;\">between 6.30 am and 5.30 pm, Monday to Friday.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3>Shiftwork<\/h3>\n<p>Shiftwork means work extending for at least 2 weeks and performed either in daily recurrent periods, wholly or partly between the hours of 6.30 pm and 8.30 am or in regular rotating periods but does not include work performed by day workers.<\/p>\n<table>\n<tbody>\n<tr>\n<td>\n<p style=\"text-align: center;\"><strong>Afternoon shift<\/strong><\/p>\n<\/td>\n<td style=\"text-align: center;\">finishing after 6.30 pm but not later than 12.30 am<\/td>\n<\/tr>\n<tr>\n<td>\n<p style=\"text-align: center;\"><strong>Day shift<\/strong><\/p>\n<\/td>\n<td>\n<p style=\"text-align: center;\">starting at 5.30 am or later, but finishing at or before 6.30 pm<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\"><strong>Night shift<\/strong><\/td>\n<td>\n<p style=\"text-align: center;\">finishing after 12.30 am but not later than 8.30 am<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\"><strong>Rostered shift<\/strong><\/td>\n<td>\n<p style=\"text-align: center;\">employee concerned has received at least 48 hours\u2019 notice<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h4><strong>Shiftwork hours and shift rosters<\/strong><\/h4>\n<p>The hours of work of employees performing shiftwork must be an average of 38 per week. The ordinary hours of work must not exceed 8 continuous hours per day (inclusive of meal breaks) on one of the following bases:<\/p>\n<ul>\n<li aria-level=\"1\">38 hours within a work cycle not exceeding 7 consecutive days;<\/li>\n<li aria-level=\"1\">76 hours within a work cycle not exceeding 14 consecutive days;<\/li>\n<li aria-level=\"1\">114 hours within a work cycle not exceeding 21 consecutive days; or<\/li>\n<li aria-level=\"1\">152 hours within a work cycle not exceeding 28 consecutive days.<\/li>\n<\/ul>\n<h3>Breaks<\/h3>\n<table>\n<tbody>\n<tr>\n<td>\n<p style=\"text-align: center;\"><strong>Regular meal break:<\/strong><\/p>\n<\/td>\n<td>\n<ul>\n<li aria-level=\"1\">The meal break must be of a regular duration of not more than one hour or less than 30 minutes; and<\/li>\n<li aria-level=\"1\">start no earlier than 3 and a half hours and no later than 5 and a half hours after the fixed starting time of the employee\u2019s ordinary hours of work; and<\/li>\n<li aria-level=\"1\">where reasonable and practical, be taken at a time to coincide with any requirement to take a break under fatigue management rules\/regulations, or as otherwise required by the employer.<\/li>\n<li aria-level=\"1\">If the meal break is not allowed, all time worked after the starting time of the regular meal break until a break without pay for a meal time is allowed must be paid for at 200% of the applicable minimum hourly rate<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<p style=\"text-align: center;\"><strong>Meal and rest breaks after ordinary hours and before overtime hours:<\/strong><\/p>\n<\/td>\n<td>\n<ul>\n<li aria-level=\"1\">An employee required to work overtime for 2 hours or more after working ordinary hours must be allowed a paid break of 20 minutes before commencing overtime work or as soon as practicable after commencing overtime work.<\/li>\n<li aria-level=\"1\">A further rest break must be allowed after completing each 4 hour period until the overtime work is finished. Any rest breaks will be paid for at the applicable minimum hourly rate.<\/li>\n<li aria-level=\"1\">Wherever reasonable and practical, the rest break must be taken at a time to coincide with any requirement to take a break under fatigue management rules\/regulations.<\/li>\n<li aria-level=\"1\">An employer and employee may agree to apply any variation of this provision in order to meet the transport and distribution award, leave entitlements for employees are determined by the National Employment Standards (<a href=\"https:\/\/www.fwc.gov.au\/documents\/awards\/resources\/nes.pdf\">NES<\/a>) and the classification of the employee.<\/p>\n<h3>Annual leave<\/h3>\n<p>All annual leave is per the National Employment Standards <a href=\"https:\/\/www.fwc.gov.au\/documents\/awards\/resources\/nes.pdf\">NES<\/a>. Employees are entitled to 4 weeks paid leave per year, plus an additional week for some shift workers.<\/p>\n<h4><strong>Annual leave loading<\/strong><\/h4>\n<p>During a period of annual leave an employee will receive a loading calculated on the minimum wage rate in clause 17\u2014Minimum rates.
