We also name it Ordinance 713 for short. From the commencement date, the employees\u2019 statutory entitlements shall be calculated on the basis of ADW (average daily wage earned in the preceding 12 months) , and the \u201cwages\u201d defined in Employment Ordinance should be included in ADW calculation.<\/p>\n<h2 id=\"title-idx-0\" class=\"icon-anchor\">Wages Calculation: Not As Easy As You Think!<\/h2>\n<p>If you\u2019re calculating an employee\u2018s paid leave by basic salary or simply deducting one-day wages, it\u2019s a big mistake!<\/p>\n<p>Upon commencement of the E(A)O 2007, regardless of whether an employee is monthly, daily or piece rate, his relevant statutory entitlements shall be calculated on the basis of his 12-month average wages; and in computing his average wages, any periods and wages that fall under the \u201cdisregarding provisions\u201d shall be excluded.<\/p>\n<h2 id=\"title-idx-1\" class=\"icon-anchor\">Employees employed on continuous contracts: How to calculate their statutory holiday pay and annual leave pay?<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-21652 aligncenter\" src=\"https:\/\/www.workstem.com\/wp-content\/uploads\/2022\/09\/418-.png\" alt=\"418\" width=\"790\" height=\"391\" srcset=\"https:\/\/www.workstem.com\/wp-content\/uploads\/2022\/09\/418-.png 539w, https:\/\/www.workstem.com\/wp-content\/uploads\/2022\/09\/418--300x149.png 300w\" sizes=\"auto, (max-width: 790px) 100vw, 790px\" \/><\/p>\n<p>*It is reported that the Labour Department is reviewing Ordinance 418 under the &#8220;Employment Ordinance&#8221; in 2023, initially put forward 4 plans, and consult the opinions of both employers and employees. According to these plans, the authorities propose to use 4 weeks to calculate the total working hours and require employees to work a total of 72, 68, 64, and 60 hours in 4 weeks in order to enjoy more statutory entitlements.<\/p>\n<h3>Statutory holiday pay<\/h3>\n<p>Calculation method: Average Daily Wage: Employment Ordinance requires that the following periods and wages are not counted:<\/p>\n<p>(i) The employee taking any of the leave below:<\/p>\n<ul>\n<li>leave provided under the Employment Ordinance (i.e. rest day, statutory holiday, annual leave, maternity leave, paternity leave or sickness day);<\/li>\n<li>sick leave due to work injuries as provided under the Employees\u2019 Compensation Ordinance; or<\/li>\n<li>leave taken with the agreement of the employer;<\/li>\n<\/ul>\n<p>(ii) The employee not being provided by the employer with work on any normal working day.<\/p>\n<p>*Statutory holidays (labour leave)<\/p>\n<table>\n<tbody>\n<tr>\n<td><span style=\"font-weight: 400\">New Year\u2019s Day<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">First three days of Lunar New Year<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">Ching Ming Festival<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">Labour Day(May 1st.)<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">Buddha&#8217;s Birthday<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">Tuen Ng Festival<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">July 1st. (National Day)<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">Chinese Winter Solstice Festival or Christmas Day(at the option of the employer)<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>\u3010Periods and Wages to be Disregarded\uff1aWhen an employee is not paid his wages or full wages and then exclude the periods together with the wages paid to the employee for such periods\u3011<\/p>\n<p><strong>How to calculate average monthly wage?<\/strong><\/p>\n<p>Average monthly salary: average daily wage x average number of working days per month<\/p>\n<table>\n<tbody>\n<tr>\n<td><span style=\"font-weight: 400\">Average daily wages =\u00a0<\/span><\/td>\n<td><span style=\"font-weight: 400\">total wages\/total number of working days<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400\">Average working days per month =<\/span><\/td>\n<td><span style=\"font-weight: 400\">working days per week x (365 days \u2013 statutory holidays) \/ 12 months<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>*Average working days per month: Generally speaking, the number of working days per month will be affected by factors such as weekends, statutory holidays, and special arrangements of the company, so it is necessary to estimate the actual number of working days per month.
