*According to the Employment (Amendment) Ordinance 2021, the newly added statutory holiday from 2024 onwards is the first weekday after Christmas Day.

What is the difference between a public holiday and statutory holiday?

HK public holiday

According to “General Holidays Ordinance”, employees are entitled to 17 days of holiday every year, also with every Sunday. Public holidays apply to all public and private organisations, including government agencies, banks, schools, large corporations and more.

HK statutory holiday

According to the “Employment Ordinance”, employees are entitled to 14 statutory holidays each year from 2024, and will gradually increase to 17 days. According to the 2024 holiday arrangement, statutory holidays are 3 days less than public holidays, excluding Good Friday and Easter among public holidays.

Statutory holidays are for workers employed in small-scale private enterprises or institutions, F&B and retail industries to mainly protect employees’ rights to rest.

In 2024, employees can apply for 3-day leave and have a total 10-day leave. Good Friday, Easter and Ching Ming Festival are close together. If you apply for 3-day leave, you can take 10 days off in a row. If you ask for leave between the Lunar New Year and Christmas, you can also take a 9-day leave.
