The NDIS sector supports over half a million Australians and their families. Individuals working in this sector are typically employed under one of three key Modern Awards:

  • Social, Community, Home Care And Disability Services Award (SCHADS Award)
Covers crisis assistance, social and community services, home care, and family day care workers.
  • Aged Care Award
Pertains to aged care industry workers such as personal care workers, cleaners, and administrative staff.
  • Nurses Award
Applicable to health industry workers, particularly nurses and their assistants.

These Awards commonly establish the minimum pay rates for workers in the sector. The updated pay rates for NDIS workers have been implemented as of 1st July 2024.

Pay Rise Eligibility for NDIS Workers

In 2023, trade unions submitted an application to the Fair Work Commission to review pay rates in care industries, particularly for employees in ‘direct care’ roles, aiming to rectify historical underpayment and challenge gender bias in caregiving roles. The Commission, under the ‘work value case,’ has been progressively addressing this issue since November, emphasizing:

  • Efficient adaptation to labor market changes.
  • Ensuring workers receive fair wages to prevent undervaluation of their contributions.

Eligible for a pay rise

  • Personal care workers (PCWs) and recreation/lifestyle activities officers.
  • Nursing staff in aged care or NDIS.
  • Home care workers in aged care or the NDIS.

Not currently eligible

  • Support and administrative staff.
  • Chefs and cooks under the Aged Care Award.
  • Employees in the NDIS, Aged Care, or Nursing industries not in ‘direct care’ roles.

Determining Eligibility under Different Awards

To ascertain if an employee is eligible for a pay rise, consider two key questions:

  • Does the employment contract reference the SCHADS, Aged Care, or Nurses Award?
  • Do the employee’s duties involve providing care services?
