As a casual employee in Australia, understanding how your taxes work is key to making sure compliance with Australian labor law and the Fair Work Act. Casual employment offers flexibility, but it also comes with specific tax responsibilities that differ from those of full-time and part-time employees.
Did You Know?
Casual workers don’t receive the same entitlements as permanent employees, such as paid sick leave or annual leave. However, casual employees are compensated through a higher hourly wage, typically including a casual loading of 25%.
The Casual Employment Information Statement
Since 26 August 2024, the Fair Work Ombudsman or FWO, for short, mandates that all casual employees receive a Casual Employment Information Statement (CEIS) from their employer as part of the new ‘Closing Loopholes’ laws. This document outlines your rights and responsibilities, including your eligibility for casual conversion (the option to transition to either full-time or part-time employment) and explains key tax obligations.
- The CEIS will inform you of the tax requirements specific to casual workers and provide clarity on your entitlements, such as superannuation and overtime.
- Receiving this statement ensures you understand your working conditions, helping you to avoid confusion about tax deductions or possible underpayment conditions.
Note: It’s essential to review this document carefully to ensure you’re aware of all the entitlements and responsibilities.
Tax Rate
As a casual employee, your tax deductions are based on the total income you earn and how much is deducted depends on whether you’ve provided your employer with a valid Tax File Number (TFN).
- If you don’t provide your TFN, your employer is required to withhold tax at the highest marginal rate, which can be significantly higher than if you’ve given your TFN.
- Additionally, if you work multiple casual jobs, only one employer should apply the tax-free threshold currently $18,200 per year. If more than one applies this threshold, you may underpay tax throughout the year, leading to a potential tax bill at the end of the financial year.
Note: It’s important to check your pay slips regularly to ensure the correct tax deductions.
Superannuation
You are entitled to superannuation contributions if you earn more than $450 one calendar month from a single employer. These contributions, made by your employer, are in addition to your wages and are not included in your take-home pay.
- Your superannuation contributions are taxed at a rate of 15% when deposited into your super fund. Although this doesn’t directly affect your income tax, it’s a significant component of your total remuneration.
- Superannuation contributions don’t affect your regular tax deductions but can provide long-term benefits by growing your retirement savings, even as a casual employee.
Note: Tracking your super contributions is critical to ensuring your employer is meeting their legal obligations.
Tips to Ensure Correct Tax Payments
Keep track of your income: Use a tax or payroll software to monitor your earnings and tax deductions.
Understand your pay slips: Make sure your pay slips show the correct tax deductions and superannuation contributions.
Lodge your tax return annually: File a tax return with the ATO each year, even if you’ve only worked casually, You might be entitled to a tax refund.
Check for overpayments: If too much tax has been withheld, you may be eligible for a refund when lodging your tax return.
Use ATO’s calculator: This calculator can help you determine if you need to request additional tax withholding.
